Vibe Coding Incubator LLC respects intellectual-property rights and responds to claims of infringement on VCI Marketplace. This Policy describes how to send a notice under the United States Digital Millennium Copyright Act, how the targeted seller can submit a counter-notice, and how we handle other intellectual-property complaints (trademark, patent, right of publicity, design rights).
1. Designated Agent for DMCA notices
We have designated the following agent to receive notifications of claimed copyright infringement under 17 U.S.C. ยง 512(c) of the DMCA:

2. How to submit a DMCA notice
If you believe content on the Platform infringes your copyright, send a notice that includes all of the following:
- a physical or electronic signature of the copyright owner or person authorized to act on their behalf;
- identification of the copyrighted work claimed to have been infringed (or, for multiple works at the same site, a representative list);
- identification of the material claimed to be infringing or to be the subject of infringing activity that is to be removed or disabled, with information reasonably sufficient for us to locate the material (e.g., the listing URL on marketplace.vcinc.ai);
- information reasonably sufficient for us to contact you (a postal address, a telephone number, and an email address);
- a statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
- a statement that the information in the notice is accurate, and under penalty of perjury, that you are the owner of the copyright or are authorized to act on the owner's behalf.
Send the notice to the Designated Agent listed in Section 1. Incomplete notices may not be processed.
3. What happens after we receive a valid notice
On receipt of a notice that substantially complies with the requirements in Section 2, we will:
- disable access to the allegedly infringing material;
- notify the seller (or other affected user) that the material has been disabled, and forward a copy of the notice;
- record the notice in our internal log of takedown requests for transparency and recidivist tracking.
4. Counter-notice
If you are a seller (or other user) whose content has been disabled and you believe in good faith that it was disabled as a result of mistake or misidentification, you may submit a counter-notice. Send it to the Designated Agent in Section 1. A counter-notice must include all of the following:
- your physical or electronic signature;
- identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before removal;
- a statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification of the material;
- your name, address, and telephone number, and a statement that you consent to the jurisdiction of the United States District Court for the judicial district in which your address is located, or, if your address is outside the United States, for any judicial district in which we may be found, and that you will accept service of process from the person who provided the original notice or an agent of that person.
On receipt of a counter-notice, we will:
- forward the counter-notice to the original complainant;
- replace the removed material or cease disabling access to it within 10 to 14 business days, unless we first receive notice from the complainant that they have filed an action seeking a court order to restrain the user from infringing activity related to the material.
5. Repeat infringers
It is our policy to terminate, in appropriate circumstances, the accounts of users we determine to be repeat infringers, including sellers whose listings have been the subject of multiple confirmed DMCA notices and who do not have valid counter-notices on those listings.
6. Misrepresentations
Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents (a) that material is infringing, or (b) that material was removed or disabled by mistake or misidentification, may be liable for damages. Do not submit a notice or counter-notice unless you genuinely believe it is accurate.
7. Trademark, patent, right of publicity, and other IP claims
For trademark complaints, patent complaints, right-of-publicity complaints, and other intellectual-property claims that are not within the scope of the DMCA, send your notice to legal@vcinc.ai with a subject line that identifies the type of claim ("Trademark Notice," "Patent Notice," etc.). The notice should include:
- your name and contact details (or those of the authorized agent acting on the rights holder's behalf);
- the right asserted, with sufficient information for us to verify it (registration number where applicable);
- the URL or other identifier of the allegedly infringing content;
- a description of how the content infringes;
- a good-faith statement, and a statement of accuracy.
We will evaluate non-DMCA claims on their merits and may, in our discretion, require additional information, mediate between the parties, disable content, or take other action consistent with applicable law and our Terms.
8. Confidentiality and contact disclosure
We may share the contents of any notice (including the complainant's identity and contact details) with the affected user and, where applicable, with law enforcement. If you do not want your identity revealed, ask an authorized agent to file on your behalf and identify themselves as the agent.
9. Modifications
We may update this Policy. The "Last updated" date at the top reflects the most recent revision.
